By using Niya One, you agree to these terms.

  1. Nature of Niya One

1.1 Niya Echo

A one-to-one human listening space offering emotional presence and alignment support.
Echo is not therapy, not counselling, not medical care, and not crisis support.

1.2 Niya Guidance

Reflective, non-clinical support for clarity and alignment.
Guidance is not coaching or psychological treatment.

1.3 Niya Nova

AI-assisted reflection providing prompts and alignment insights.
Nova is not a diagnostic tool.

1.4 Niya Community

A moderated digital environment for aligned individuals.
User content remains the responsibility of the user who posts it.

Niya One does not provide crisis intervention or emergency response.

Niya cannot assume responsibility for users who fail to seek emergency assistance.

  1. Eligibility

You must be:

  • at least 18 years old
  • legally capable of entering into an agreement
  • using the service for personal, non-commercial use

Minors cannot use Niya One.

  1. Guardian Anonymity & User Conduct

To maintain neutrality, safety, and privacy:

  • Guardians use nicknames only
  • Guardians do not share personal details
  • Guardians cannot disclose identity, location, beliefs, or background
  • Users may not attempt to discover or contact Guardians outside the platform

Any violation results in immediate account suspension.

Users must not:

  • record sessions independently
  • harass Guardians or other users
  • use Niya One as therapy or medical guidance
  • use the platform during emergencies
  1. Session Recording & Consent

Some Echo sessions may be recorded only if you explicitly consent.

✔ Recording is ON by default — but does not begin until you approve.

✔ You may decline and still use the service.

✔ You may withdraw consent at any time.

5.1 Purpose of Recording

If you consent, recordings may be processed:

“by automated systems to improve the quality, safety, and performance of our Services.”

Recordings are:

  • anonymised before internal analysis
  • never used for identity recognition
  • never shared with external commercial parties
  • protected under strict access controls

5.2 Storage Duration

Recordings are stored for up to 24 months, then deleted or fully anonymised.

  • Payment information (processed by Stripe)
  • Optional user profile details

  • Device and technical information
  • Usage logs
  • Audio recordings (only with consent)

6.3 Sensitive data

Niya does not require health data.
If voluntarily shared, it is used solely to deliver the service.

  1. Legal Basis for Processing (GDPR / UK GDPR)

We rely on:

  • Contractual necessity – to deliver services
  • Explicit consent – for session recording and automated analysis
  • Legitimate interests – for safety, fraud prevention, improvement
  • Legal obligations – for compliance where required

We do not engage in automated decision-making that produces legal or significant effects.

  1. Data Storage & International Transfers

✔ Your data is stored on secure servers located within the European Union or in other regions that provide adequate protection under GDPR.

✔ We do not transfer or store personal data in jurisdictions without adequate protection.

✔ Guardians do not access your stored personal data.

They only receive what is necessary to conduct the live session.

✔ Audio streams are encrypted and do not constitute a data transfer under GDPR when the server remains in the EU.

This keeps your operational model completely protected and fully compliant.

  1. Automated Systems & AI Transparency

We may use automated systems to:

  • improve quality
  • support safety
  • analyse anonymised recordings (if consented)
  • provide reflective insights (Nova)

We do not:

  • identify users by voice
  • profile users for advertising
  • sell or rent user data
  • make automated decisions with legal impact

  1. Data Retention

  • Account data: while your account remains active
  • Recordings: max 24 months, then deleted or anonymised

Our maximum liability is limited to the amount you paid for the service.
